If your only tool is a hammer, every problem begins to look like a nail. Unfortunately, trying to solve every legal dispute with brute force can be the worst approach for a business, even if the business ultimately prevails. It can take time, money and emotional energy away from what business owners should be concentrating on: making their businesses more successful and profitable.

Many litigators love what they do: They thrive on doing battle. For them, combat is both fun and profitable. It is easy to feed on the raw emotions of parties in the beginning stages of a dispute. Over time, the heat cools down but the attorney bills keep on coming.

With a background split between transactional work and litigation, Joel takes a different view of conflicts. He tries initially to find a quick, inexpensive and fair way out for the parties. Frequently, if the money spent on attorneys were thrown into the settlement pot, both parties would come out ahead financially. Additionally, they would have a certain and acceptable outcome, instead of rolling the dice on success or failure. This is, in essence, applying a transactional approach to disputes: Try to find common ground and develop an agreement, allowing the parties to get back to doing what they do best - running their businesses.

When a quick settlement is not possible, Joel has the skills to go head-to-head with the best of them. In such situations, Joel's experience on the transactional side of business and real estate law enhances his ability to understand the facts and law underlying the case.

Currently, his practice is split between transactional law and litigation.

Benefits to you are three-fold:

  • Ability to render a reasoned judgment about both litigation and non-litigation dispute resolution options, based on a global knowledge base grounded in contract and other transactional law;
  • Predisposition to conclude a transaction amicably, often without having to resort to trial measures-which can lessen client stress, shorten the timeline, and keep costs down;
  • Seasoned knowledge and determination to be a very formidable and well-informed adversary in those circumstances when trial becomes necessary.
